A Commercial Lessor License is required for a business that will lease its premises to non-profit organizations for the purpose of conducting charitable gaming activities, such as bingo games and games of chance. The New York City Department of Consumer and Worker Protection (DCWP) issues this license.

Businesses must obtain applicable business certificates, based on their legal structure as described below. Although DCWP does not require hardcopy submission of business certificates, DCWP reserves the right to request and examine the documents under section 20.104 of the New York City Administrative Code.
Sole Proprietorships operating under a trade or Doing-Business-As (DBA) name must file a Doing-Business-As / Assumed Name Certificate with the clerk of the county in which the business is conducted. Sole Proprietors doing business under their own name - and not under a trade or DBA name - do not need a Business Certificate.

Corporations, Limited Partnerships, Limited Liability Companies, or Limited Liability Partnerships must register and remain active with the New York State Department of State (NYS DOS). Active status will be verified by DCWP prior to license issuance. Note: If operating under an Assumed or Doing-Business-As (DBA) Name, an Assumed Name Certificate must also be filed.

Businesses incorporated outside of New York State must obtain a Certificate of Doing Business in Good Standing from the Secretary of State from the business' home state, and file it with an application for Authority to Conduct Business in New York with the New York State Secretary of State.

Submit a copy of the Certificate of Occupancy, Temporary Certificate of Occupancy (expiring no less than 30 days from date of application submission), or Letter of No Objection from the Department of Buildings (DOB) confirming that the business' premises is suitable for the business. If submitting a Certificate of Occupancy or Temporary Certificate of Occupancy, it must be the most current version and show approval of the premises for "Use Group 6" and "Bingo," "Bingo Hall," "Meeting Hall," or "Meeting Room."

If the premises will accommodate 75 or more persons, submit a copy of the Place of Assembly Certificate of Operation issued by the Department of Buildings (DOB).

If the license application will be filed by someone other than the applicant, complete the Granting Authority to Act Affirmation.

Granting Authority to Act

All Sole Proprietors, General Partners, Directors, Corporate Officers, and Shareholders owning 10% or more of company stock must be fingerprinted at the DCWP Licensing Center. Each person who will be fingerprinted must bring valid photo identification (ID). Acceptable forms of ID include: a driver's license or a non-driver's ID issued by a State Department of Motor Vehicles; a license or permit issued by a government agency; a passport; an alien card / green card; or if applicant is a City, State or Federal employee, an employee identification card. EXCEPTIONS: Any person who currently has fingerprints on file with DCWP does not need to be fingerprinted. DCWP has fingerprints on file for anyone who provided fingerprints within the last three years and for those who provided fingerprints for an active DCWP license.

List of Fees.

  • $5,010: License Fee for applicants who file for a Commercial Lessor License with aggregate rent of more than $100,000 that will be collected from non-profit organizations conducting charitable gaming activities.
  • $2,510: License Fee for applicants who file for a Commercial Lessor License with aggregate rent between $50,000 and $100,000 that will be collected from non-profit organizations conducting charitable gaming activities.
  • $75: Fingerprint Processing Fee per person.
  • 2.49% of credit card payment amount: Non-Refundable Convenience Fee for paying with a credit card.

  • Money Order (Payable to NYC Department of Consumer and Worker Protection, accepted only for in person application submissions.)
  • Credit card including Visa, MasterCard, American Express, and Discover Card.
Within two weeks of DCWP receiving all required materials, applicants will receive one of the following notifications by mail with the status of their license application.
- If the application is approved, DCWP will issue the applicant a license document.
- If the application requires additional information, DCWP will notify the applicant by mail with instructions on how to submit this information. If the applicant does not submit the requested materials to DCWP within 10 days of receiving this notification letter, the application will be denied.
- If the application is denied, DCWP will provide an explanation for the denial and information about the reapplication process.
Licenses are valid for up to one year and expire on December 31 every year.
If any of the information submitted in the approved application changes, the licensee must inform DCWP of those changes by calling 311 or by visiting the DCWP Licensing Center. DCWP recommends that licensees call 311 to confirm that they need to go to the Licensing Center for any specific change.
If the licensee plans to continue to use its premises for charitable gaming activities, the licensee must complete and file a new license application package by repeating the steps outlined in the Apply tab.

Complete the required application forms and gather all necessary documentation identified in the section above.
File all documentation and pay the required fees at the DCWP Licensing Center. The DCWP Licensing Center is open between 9:00 a.m. and 5:00 p.m. on Mondays, Tuesdays, Thursdays and Fridays, and between 8:30 a.m. to 5:00 p.m. on Wednesdays.
