The Fair Play Act protects anyone who works for a construction business. This law makes sure businesses give workers their rights.
Businesses cannot call workers independent contractors unless:
- The worker is free to do their job without direction or control.
- The work they do is separate from the business's usual work.
- The worker has their own business.
Employee benefits
Employees, contractors and subcontractors who do not meet these rules must get certain benefits, including:
- Unemployment insurance
- Worker's compensation
- Overtime pay
Payment for wages must be on time and above the minimum wage. All are entitled to a safe work environment.
Posting requirements
- Required notice: Businesses must post a notice about the Fair Play Act in workplaces.
- Spanish notice: If many workers speak Spanish, the notice must be in Spanish.
Penalties
Businesses that break the law will be punished.
